Listener Agreement

This Listener Agreement (“Agreement”) governs the relationship between Cry-Fi (“Cry-Fi”, “Platform”, “we”, “our”, or “us”) and individuals who register, apply, or provide emotional support services as Listeners on Cry-Fi.
By registering, being approved, or providing services as a Listener on Cry-Fi, you agree to this Agreement and all applicable Cry-Fi policies.
1. Independent Status
Listeners operate as independent service providers and are not employees of Cry-Fi.
Nothing in this Agreement is intended to create:
Employment
Partnership
Agency
Joint venture
Employer-employee relationship
Listeners are responsible for their own conduct, services, taxes, legal obligations, and compliance with applicable laws.
Cry-Fi operates as a technology marketplace facilitating connections, bookings, payments, and related Platform functionality.
Unless expressly stated otherwise, Cry-Fi does not control the manner in which a Listener independently provides their services, subject to Platform rules, safety requirements, and applicable law.
2. Eligibility
To become a Listener, you must:
Be at least eighteen (18) years old
Provide accurate information
Complete Cry-Fi’s applicable vetting process
Provide requested identity verification
Have legal capacity to enter into this Agreement
Comply with applicable laws and Cry-Fi policies
Cry-Fi may approve, reject, restrict, suspend, or terminate Listener accounts where reasonably necessary, subject to applicable law.
Approval as a Listener does not constitute a guarantee of professional qualifications, licensing, expertise, or future eligibility beyond the verification or vetting processes Cry-Fi actually performs.
3. Listener Responsibilities
Listeners agree to:
Conduct sessions respectfully
Maintain appropriate boundaries
Follow all Cry-Fi policies
Provide the service represented in their listing
Be available during confirmed booking times
Communicate honestly
Avoid abusive or manipulative behavior
Avoid misleading professional claims
Respect user privacy and confidentiality to the extent required by applicable law and Cry-Fi policies
Comply with applicable safety requirements
Listeners remain responsible for the services and conduct they provide.
4. Strict Non-Sexual Service Requirement
Cry-Fi is strictly a non-sexual emotional-support marketplace.
Listeners must not use Cry-Fi to provide, request, promote, arrange, or facilitate sexual interactions or services.
Prohibited conduct may result in session termination, account suspension, permanent removal, payment restrictions, and, where appropriate, lawful reporting.
This requirement applies to:
Platform communications
Video Sessions
Audio Sessions
Offline Sessions
Booking-related interactions
Other interactions facilitated through Cry-Fi
Romantic or sexual services, sexual solicitation, sexualized interactions, escorting, or using emotional-support sessions as a means of arranging sexual activity are not permitted.
5. No Therapy or Medical Representation
Unless expressly authorized and appropriately represented by Cry-Fi, Listeners must not present Cry-Fi services as:
Medical treatment
Therapy
Psychological treatment
Diagnosis
Healthcare
Crisis intervention
Professional medical advice
Listeners must not falsely claim qualifications, licenses, certifications, or professional expertise they do not possess.
Cry-Fi’s emotional-support services do not replace qualified professional or emergency services.
Listeners must not represent themselves as acting on behalf of Cry-Fi as licensed healthcare or mental-health professionals merely because they are approved to provide services through the Platform.
6. Session Boundaries
Listeners must:
Respect user boundaries
Avoid creating emotional dependency for financial gain
Avoid coercive upselling
Avoid manipulative behavior
Avoid exploiting vulnerable users
Avoid requesting unnecessary sensitive information
Respect a user’s decision to end a session
Avoid intentionally encouraging unhealthy dependency on the Listener or Platform
Cry-Fi may investigate patterns suggesting exploitation, manipulation, coercion, or other policy violations.
7. Gender Preference & Session Compatibility
Listeners may specify a Gender Preference for a particular service where this feature is available.
Gender Preference is a service-level compatibility preference indicating the gender or genders a Listener is comfortable accepting for that service.
Listeners are responsible for ensuring that their stated Gender Preference is accurate and appropriate for the service they offer.
The Gender Preference is prominently displayed on the applicable service card and service detail page, at or above the price, so Support Seekers can review it before booking.
Support Seekers are expected to review the service information, including the displayed Gender Preference, before making a booking.
Bookings are processed through the Platform based on the selected service. Listeners do not manually accept or reject individual bookings.
If a Listener discovers after connecting with a Support Seeker that the Support Seeker’s gender does not match the stated Gender Preference, the Listener may:
Politely end the session immediately if they are uncomfortable; or
Continue the session if they are comfortable doing so.
A gender mismatch by itself does not automatically create a right to a refund, compensation, payment reversal, or other special financial consequence.
This flexibility does not permit harassment, humiliation, threats, insults, abusive treatment, sexual misconduct, or other prohibited conduct.
Any allegation of misconduct is assessed separately from the existence of a Gender Preference mismatch.
8. Video Session Requirements
Where a booking includes Cry-Fi’s integrated Video Session functionality, the Listener agrees to follow the applicable session timing and access requirements.
8.1 Booking Details
Applicable Video Session meeting information may be made available through the confirmed booking details on Cry-Fi.
Listeners must use the designated Cry-Fi session access method and must not attempt to circumvent the Platform’s session access controls.
8.2 Joining the Session
Listeners are responsible for:
Checking their booking details
Joining the Video Session at the scheduled time
Maintaining a compatible device
Maintaining a reasonably stable internet connection
Ensuring microphone and camera permissions are available where required
Listeners should join sufficiently early to address ordinary technical issues.
8.3 Session Timer
Where a session timer is displayed, it indicates the scheduled session period.
The scheduled start and end times associated with the booking determine the permitted session duration.
8.4 Automatic Session Expiry
Video Sessions are designed to automatically expire at the scheduled end time.
When the scheduled session period ends:
The session may automatically terminate
Participants may be removed from the meeting
Further access may be restricted
The meeting link may no longer permit participation in the expired session
Listeners must not attempt to bypass or extend automated session controls.
8.5 No Automatic Extension
Remaining inside a Video Session does not create an entitlement to additional paid session time.
Any additional session must be separately booked through Cry-Fi unless Cry-Fi expressly provides another mechanism.
9. Video Session Technical Responsibility
Listeners are responsible for taking reasonable steps to ensure that their equipment and connection are capable of participating in an online session.
This may include:
Compatible browser or device
Camera access where applicable
Microphone access where applicable
Internet connectivity
Sufficient battery or power
Appropriate environment for conducting the session
Cry-Fi is not responsible for technical failures caused solely by the Listener’s device, internet connection, operating system, browser, power supply, or other circumstances outside Cry-Fi’s reasonable control.
Technical issues caused by Cry-Fi or its integrated systems may be reviewed under the applicable support, booking, and refund policies.
10. Video Session Privacy & Recording
Listeners must not record, capture, reproduce, distribute, publish, or commercially exploit Video Sessions or participant content without appropriate authorization or legal basis.
Listeners must also respect applicable privacy, consent, copyright, and data-protection requirements.
Cry-Fi does not represent that ordinary Video Sessions are automatically recorded or stored by Cry-Fi.
Where a third-party video service is used, its own processing, storage, and retention practices may also apply.
11. Offline Sessions
For offline sessions:
Listeners participate voluntarily
Listeners are responsible for their conduct
Listeners are responsible for taking reasonable personal safety precautions
Listeners must comply with applicable laws
Cry-Fi does not supervise the physical meeting
Cry-Fi is not responsible for incidents occurring during offline meetings beyond its reasonable control or applicable legal obligations.
Listeners should use reasonable judgment when choosing meeting locations and circumstances and should end a session if they reasonably believe their safety is at risk.
12. Pricing & Payments
Listeners may set their own pricing where permitted by Cry-Fi.
Cry-Fi currently retains 20% of the booking amount as its platform fee, with 80% allocated to the Listener, subject to applicable adjustments, refunds, disputes, taxes, payment-processing arrangements, or other applicable policies.
Cry-Fi may modify its fee structure with appropriate notice.
Listener payouts may be delayed, held, adjusted, or reversed where reasonably necessary for:
Refund processing
Chargebacks
Fraud investigations
Safety investigations
Disputes
Policy violations
Payment-provider requirements
Legal obligations
Tips, where supported by Cry-Fi, are intended for the Listener and may be subject to separate Platform rules and applicable payment-processing requirements.
13. Off-Platform Payments & Client Poaching
Listeners must not use Cry-Fi to circumvent the Platform’s booking or payment system.
Prohibited conduct includes:
Requesting direct payment for Cry-Fi bookings
Diverting users to external payment methods
Circumventing Cry-Fi’s commission
Manipulating bookings to avoid Platform fees
Using Cry-Fi’s marketplace access to establish unauthorized off-platform transactions
Encouraging Support Seekers to move an existing or prospective Cry-Fi booking off the Platform for the purpose of avoiding applicable Platform fees or protections
Violations may result in suspension, termination, payment restrictions, or other enforcement.
14. Verification & Accuracy
Listeners must keep their information accurate and current, including:
Identity information
Contact information
Profile information
Service descriptions
Pricing information
Relevant qualifications or representations
Cry-Fi may request additional verification where reasonably necessary.
Providing false, misleading, fraudulent, or materially incomplete information may result in enforcement action.
Listeners must promptly update information that becomes materially inaccurate.
15. Complaints & Investigations
Cry-Fi may investigate complaints involving:
Abuse
Fraud
Harassment
Sexual misconduct
Safety concerns
Misrepresentation
Payment manipulation
Off-platform circumvention
Intellectual property violations
Other policy violations
Cry-Fi may request supporting information or evidence reasonably relevant to an investigation.
Listeners agree to reasonably cooperate with legitimate Platform investigations.
Cry-Fi may review available Platform records, booking information, communications, reports, technical information, and other relevant information, subject to applicable law and Cry-Fi policies.
16. Suspension & Termination
Cry-Fi may suspend, restrict, or terminate a Listener account where reasonably necessary due to:
Policy violations
Safety concerns
Fraud
Misconduct
Repeated substantiated complaints
Misrepresentation
Payment abuse
Off-platform circumvention
Intellectual property violations
Legal or regulatory requirements
Where circumstances require immediate action, Cry-Fi may restrict access without prior notice, subject to applicable law.
Depending on the circumstances, enforcement may also include ending active sessions, preventing future bookings, restricting Platform features, or holding or adjusting payouts where permitted by applicable policies and law.
17. Taxes & Legal Compliance
Listeners are solely responsible for their own:
Taxes
Income declarations
Business registrations where required
Licenses or permits where applicable
Regulatory obligations
Other legal obligations arising from their activities
Cry-Fi does not provide tax or legal advice to Listeners.
Listeners are responsible for determining whether any license, registration, qualification, or other authorization is required for the services they independently provide.
18. Listener Content & Intellectual Property
Listeners retain ownership of original content they create, subject to the Intellectual Property & Copyright Policy.
Listeners grant Cry-Fi the rights reasonably necessary to:
Display Listener profiles
Facilitate bookings
Provide Platform services
Promote Listener listings within the Platform
Moderate content
Investigate complaints
Maintain Platform operations
Comply with applicable legal or safety requirements
Listeners must not upload or use intellectual property belonging to others without appropriate authorization.
Additional intellectual-property terms are governed by Cry-Fi’s Intellectual Property & Copyright Policy.
19. Limitation of Platform Responsibility
Cry-Fi operates as a marketplace and technology platform.
To the extent permitted by applicable law, Cry-Fi is not responsible for:
Listener income expectations
User dissatisfaction
Participant misconduct
Offline incidents beyond Cry-Fi’s reasonable control
User-generated content
Third-party service failures
Technical problems outside Cry-Fi’s reasonable control
Independent services provided by Listeners
Nothing in this Agreement excludes or limits liability that cannot legally be excluded or limited.
20. Indemnification
To the extent permitted by applicable law, Listeners agree to indemnify and hold Cry-Fi harmless against claims, losses, liabilities, damages, costs, and reasonable legal expenses arising from:
Their unlawful conduct
Their independently provided services
Their violation of Cry-Fi policies
Their violation of applicable law
Their infringement of third-party rights
Their misuse of the Platform
This provision does not apply to the extent a claim is caused by Cry-Fi’s own unlawful conduct or liability that cannot legally be excluded or limited.

This Agreement should be read together with all applicable Cry-Fi policies, including:

Age Restriction (18+) Policy
Other applicable Cry-Fi policies
These policies form part of the overall rules governing Listener participation on Cry-Fi.
Where multiple policies address the same subject, they should be interpreted together to the extent reasonably possible.
22. Modifications
Cry-Fi may update this Agreement from time to time.
The updated version will be published on the Platform with a revised “Last Updated” date.
Where required by applicable law, Cry-Fi may provide additional notice regarding material changes.
Continued participation as a Listener after the effective date of an updated Agreement constitutes acceptance of the updated Agreement to the extent permitted by law.
