These Terms & Conditions (“Terms”) govern your access to and use of Cry-Fi (“Cry-Fi”, “Platform”, “we”, “our”, or “us”), including its website, services, sessions, features, communications, marketplace functionality, and related services.

These Terms should be read together with the applicable Cry-Fi policies referenced below. If you do not agree with these Terms or applicable policies, you should discontinue use of the Platform.


1. Platform Nature

Cry-Fi is a technology-based marketplace that connects users with independent Listeners for general emotional support conversations and related services.

Cry-Fi:

  • Does not provide therapy, psychiatry, psychological treatment, medical treatment, or emergency services.

  • Does not employ Listeners as employees.

  • Does not act as the employer, agent, partner, joint venturer, or healthcare provider of any Listener.

  • Does not supervise or physically control live sessions.

  • Does not guarantee the conduct, availability, qualifications, suitability, quality, or reliability of any Listener beyond the specific verification or vetting actually performed by Cry-Fi.

  • Does not guarantee any emotional, personal, therapeutic, medical, or other outcome.

  • Does not guarantee that any particular Listener or service will remain available.

Listeners operate independently and remain responsible for their own conduct, services, representations, legal obligations, and applicable taxes.

Cry-Fi primarily provides the technology, marketplace infrastructure, booking functionality, payment facilitation, communication tools, and related platform services.


2. Eligibility

To use Cry-Fi:

  • You must be at least eighteen (18) years old.

  • You must provide truthful, accurate, and reasonably current information.

  • You must have the legal capacity to enter into applicable agreements.

  • You must comply with applicable laws and Cry-Fi policies.

Cry-Fi may request age or identity verification where reasonably necessary and may restrict, suspend, or terminate accounts that do not satisfy applicable eligibility requirements.

Cry-Fi does not permit minors to register, book, provide, or participate in Cry-Fi sessions.


3. Services

Cry-Fi may provide or facilitate:

  • Online sessions.

  • Offline sessions.

  • One-on-one sessions.

  • Messaging-based support.

  • Other individual emotional-support or conversation formats introduced by Cry-Fi.

Cry-Fi does not currently offer group sessions.

Cry-Fi may modify, suspend, restrict, or discontinue features or services where reasonably necessary, including for operational, technical, security, safety, legal, or business reasons.

The availability, duration, pricing, format, and specific terms of a service may vary by Listener and service listing.


4. User Responsibility & Assumption of Risk

Participation in Cry-Fi is voluntary.

Users and Listeners are responsible for:

  • Their own decisions and conduct.

  • Evaluating the suitability of a particular participant or service.

  • Respecting personal boundaries.

  • Providing accurate information.

  • Taking reasonable safety precautions.

  • Maintaining appropriate privacy and security.

  • Following applicable Cry-Fi policies and laws.

Users acknowledge that emotional conversations may involve personal, sensitive, or difficult subjects and that individual experiences may vary.

Offline sessions involve additional risks because Cry-Fi does not supervise or control physical meetings, locations, transportation, or participant behavior.


5. Strict Prohibition of Sexual Conduct

Cry-Fi is strictly non-sexual.

The following are prohibited:

  • Sexual conversations or requests for sexual purposes.

  • Sexual solicitation.

  • Sexual roleplay.

  • Sexually explicit content or interactions.

  • Sexual advances.

  • Sexual harassment.

  • Sexual coercion.

  • Sexual exploitation.

  • Sexual services or sexual companionship arrangements.

  • Non-consensual sexual conduct.

  • Using Cry-Fi to arrange or facilitate sexual or romantic services.

This prohibition applies across chats, calls, online sessions, offline sessions, profiles, listings, reviews, messages, and other Platform interactions.

Romantic or sexual relationships are not services offered by Cry-Fi.

Violations may result in immediate restriction, suspension, permanent account termination, session termination, evidence preservation, and cooperation with lawful authorities where required or permitted by law.


6. Fraud, Misrepresentation & Abuse

Users and Listeners must not:

  • Impersonate another person or organization.

  • Create fraudulent or deceptive accounts.

  • Provide false or materially misleading information.

  • Misrepresent qualifications, credentials, experience, identity, or services.

  • Engage in fraudulent activity.

  • Manipulate refund or dispute processes.

  • Submit fabricated, altered, or deliberately misleading evidence.

  • Conduct payment fraud.

  • Abuse chargeback processes.

  • Circumvent Cry-Fi fees, booking systems, verification systems, or security controls.

  • Engage in harassment, threats, intimidation, coercion, manipulation, or abuse.

  • Attempt to evade previous enforcement action through another account.

Cry-Fi may review suspected violations and take appropriate enforcement action based on available information and applicable policies.


7. Gender Preference & Session Compatibility

Listeners may specify a Gender Preference for a particular service.

Gender Preference:

  • Is a service-level compatibility preference.

  • Must accurately describe the gender or genders the Listener is comfortable accepting for that service.

  • Is displayed prominently on the service card and service detail page at or above the displayed price.

  • Is intended to help Support Seekers evaluate service suitability before booking.

Support Seekers are expected to review the Gender Preference and other service information before booking.

Bookings are processed through the Platform based on the selected service and do not require the Listener to manually accept or reject individual bookings.

If a gender mismatch becomes apparent after the participants have connected:

  • The Listener may politely end the session if they are genuinely uncomfortable; or

  • The Listener may continue the session if they are comfortable doing so.

A Gender Preference mismatch alone does not automatically create a right to a refund, compensation, payment reversal, or other special financial consequence.

However, Gender Preference does not permit harassment, insults, humiliation, threats, abuse, sexual misconduct, or other prohibited conduct. Any such conduct may be reviewed independently under the applicable Cry-Fi policies.


8. Session Termination

A participant may end a session when they reasonably believe that:

  • Abuse is occurring.

  • Harassment is occurring.

  • Sexual misconduct is occurring.

  • A safety concern exists.

  • The session falls outside Cry-Fi’s permitted scope.

  • The participant is uncomfortable continuing the interaction.

A Listener may also end a session because of a genuine Gender Preference mismatch after connection, consistent with Section 7.

Cry-Fi may review available booking, payment, communication, technical, session, or other relevant platform information where necessary.

Session termination does not automatically establish misconduct or entitlement to a refund.

Refund eligibility is governed by the Refund & Cancellation Policy.


9. Force Majeure

Cry-Fi shall not be liable for delays, interruptions, or inability to provide Platform services caused by events beyond its reasonable control, including:

  • Natural disasters.

  • Floods, earthquakes, storms, or severe weather.

  • Fire or explosions.

  • War, terrorism, civil unrest, riots, or armed conflict.

  • Government actions, regulations, restrictions, or orders.

  • Epidemics, pandemics, or public health emergencies.

  • Internet or telecommunications failures.

  • Power outages.

  • Cyberattacks, DDoS attacks, ransomware, or other large-scale security incidents.

  • Failures or substantial disruptions involving third-party hosting, cloud infrastructure, payment processors, communication services, or other essential providers.

  • Other events beyond Cry-Fi’s reasonable control.

During such events, Cry-Fi may suspend, delay, modify, restrict, or temporarily discontinue affected Platform services to the extent reasonably necessary.

Cry-Fi will make reasonable efforts to restore affected services as soon as reasonably practicable.

Nothing in this section excludes rights or obligations that cannot legally be excluded.


10. Offline Sessions

Cry-Fi does not arrange, supervise, physically monitor, or control offline meetings.

Users and Listeners acknowledge that:

  • Offline sessions are voluntarily arranged or accepted by participants.

  • Cry-Fi does not guarantee physical safety.

  • Cry-Fi does not supervise meeting locations.

  • Cry-Fi does not control transportation or surrounding circumstances.

  • Cry-Fi does not guarantee participant conduct.

  • Participants are responsible for their own safety decisions.

Cry-Fi strongly recommends that participants:

  • Use public or populated locations where appropriate.

  • Inform a trusted person about meeting arrangements.

  • Maintain control over their transportation and departure.

  • Avoid isolated locations where reasonably possible.

  • Avoid unnecessarily sharing sensitive personal information.

  • Leave immediately if they feel unsafe.

Safety concerns should be reported through the Safety & Reporting Policy.


11. No Professional or Regulated Services

Cry-Fi is not a substitute for:

  • Therapy.

  • Psychiatry.

  • Psychological treatment.

  • Medical treatment.

  • Clinical care.

  • Emergency or crisis services.

  • Legal advice.

  • Financial or investment advice.

  • Tax advice.

  • Other regulated professional services.

Information exchanged during Cry-Fi sessions must not automatically be treated as professional advice, diagnosis, treatment, or clinical care.

A Listener may independently possess professional qualifications or experience. Unless expressly stated and legally permitted by Cry-Fi, however, participation as a Listener does not make a Cry-Fi session a professional healthcare, legal, financial, or other regulated service.

The Not-a-Therapy & No Medical Advice Disclaimer and Session Scope & Limitations Policy provide additional requirements.


12. Payments

Payments may be processed through third-party payment providers.

Cry-Fi:

  • Does not intentionally store full card numbers, CVV information, or equivalent sensitive payment credentials.

  • May retain transaction-related information reasonably necessary to operate the Platform.

  • May deduct applicable platform commissions.

  • May facilitate Listener payouts through applicable payment arrangements.

  • May hold, delay, adjust, or reverse Listener payouts where permitted by applicable policies, including in connection with refunds, chargebacks, fraud, disputes, safety matters, policy violations, or legal requirements.

Unless otherwise stated, Cry-Fi’s marketplace commission is 20%, with 80% allocated to the Listener, subject to applicable refunds, disputes, taxes, payment arrangements, and other permitted adjustments.

Users are responsible for reviewing applicable charges before completing a booking or purchase.


13. Refunds & Disputes

Refunds, cancellations, credits, payment disputes, and related financial matters are governed by the Refund & Cancellation Policy.

Cry-Fi may review information reasonably relevant to a dispute, including:

  • Booking records.

  • Session information.

  • Payment records.

  • Platform communications.

  • Technical information.

  • Reports.

  • Supporting evidence.

A refund is not guaranteed merely because a user is dissatisfied with a session or because a session ended earlier than expected.

Refund abuse, fraudulent disputes, manipulated evidence, or payment abuse may result in account restrictions, suspension, or termination.


14. Off-Platform Conduct & Fee Circumvention

Users and Listeners must not use Cry-Fi to intentionally circumvent applicable Platform fees or move Cry-Fi bookings into unauthorized off-platform payment arrangements for the purpose of avoiding applicable Platform charges.

Participants must not use information obtained through Cry-Fi to engage in deceptive payment arrangements or intentionally bypass applicable Platform systems.

Cry-Fi does not control interactions that occur entirely outside the Platform and, to the fullest extent permitted by law, is not responsible for disputes, losses, misconduct, or incidents arising solely from unauthorized off-platform interactions.

This does not prevent lawful personal communication or legitimate interactions that are permitted under applicable Cry-Fi policies.


15. Emotional Dependency & Exploitation

Listeners must not intentionally create, encourage, or exploit unhealthy emotional dependency for financial, personal, romantic, or other improper gain.

Listeners must not use:

  • Manipulation.

  • Coercion.

  • Pressure.

  • Deliberate dependency-building.

  • Exploitative upselling.

  • Threats that continued support depends upon payment.

  • Misleading claims that a Support Seeker must continue booking sessions to remain safe, cared for, or emotionally supported.

Cry-Fi may review suspicious patterns and take appropriate enforcement action where reasonably necessary.


16. Advertising, Affiliates & Shop

Cry-Fi may display or provide access to:

  • Advertisements.

  • Affiliate links.

  • Sponsored content.

  • Shop listings.

  • Third-party products or services.

Cry-Fi may receive revenue, commissions, or other commercial benefits from certain third-party arrangements.

Advertising, affiliate, sponsorship, or commercial arrangements do not automatically guarantee or determine:

  • Listener visibility.

  • Search ranking.

  • Booking eligibility.

  • Availability.

  • User access.

  • Policy enforcement.

  • Safety decisions.

Third-party products and services remain subject to their respective providers’ terms, policies, warranties, and practices.


17. Account Suspension & Termination

Cry-Fi may suspend, restrict, remove, or terminate accounts, listings, bookings, sessions, features, or Platform access where reasonably necessary, including for:

  • Policy violations.

  • Fraud.

  • Abuse.

  • Sexual misconduct.

  • Safety concerns.

  • Misrepresentation.

  • Identity or verification concerns.

  • Security concerns.

  • Payment abuse.

  • Circumvention of Platform systems.

  • Legal or regulatory requirements.

  • Conduct that materially threatens Platform integrity.

Serious violations may result in immediate action without prior notice where permitted by law.

Cry-Fi may also take temporary measures while reviewing a complaint, safety concern, suspected fraud, security issue, or other significant risk.


18. Intellectual Property

Cry-Fi and its licensors retain rights in Cry-Fi-owned:

  • Branding.

  • Logos.

  • Website design.

  • Software.

  • Platform features.

  • Text.

  • Graphics.

  • Marketing materials.

  • Other proprietary materials.

Except where expressly permitted, users may not reproduce, modify, distribute, exploit, reverse engineer, commercially use, or otherwise misuse Cry-Fi-owned intellectual property without authorization.

User-generated content remains subject to the Intellectual Property & Copyright Policy.


19. Limitation of Liability

To the fullest extent permitted by applicable law, Cry-Fi shall not be liable for losses, damages, or harm arising from matters outside Cry-Fi’s reasonable control, including:

  • Participant misconduct.

  • Personal injury or physical harm caused by participants.

  • Sexual misconduct by participants.

  • Offline incidents or meetings.

  • Emotional outcomes.

  • User decisions based on conversations.

  • Fraud independently committed by users or Listeners.

  • Unauthorized off-platform interactions.

  • Failure of third-party services.

  • Internet, telecommunications, device, or connectivity failures.

  • Events covered by the Force Majeure provisions.

Cry-Fi does not guarantee that Platform services will always be uninterrupted, secure, error-free, available, or suitable for every individual purpose.

Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited.


20. No Compensation for Certain Losses

Except where expressly provided under an applicable Cry-Fi policy or required by law, Cry-Fi does not guarantee compensation, damages, reimbursement, or settlement for:

  • Emotional dissatisfaction.

  • Personal disputes.

  • Failure to achieve a desired emotional outcome.

  • Participant misconduct outside Cry-Fi’s control.

  • Offline incidents.

  • Unauthorized off-platform interactions.

  • User-side technical or connectivity problems.

  • Losses resulting from a participant’s independent actions.

This section remains subject to rights and remedies that cannot legally be waived or excluded.


21. Indemnification

To the fullest extent permitted by applicable law, you agree to indemnify and hold Cry-Fi and its relevant personnel harmless from third-party claims, losses, liabilities, damages, and reasonable legal expenses arising from:

  • Your violation of these Terms.

  • Your violation of applicable law.

  • Your misconduct.

  • Your submitted content.

  • Your unauthorized use of the Platform.

  • Your violation of another person’s rights.

  • Your interactions with other participants.

  • Your unauthorized off-platform arrangements.

This provision applies only to the extent permitted by applicable law and does not eliminate rights or protections that cannot legally be waived.


22. Third-Party Services

Cry-Fi may rely on third-party providers for:

  • Payment processing.

  • Hosting and cloud infrastructure.

  • Analytics.

  • Advertising.

  • Communication and video services.

  • Security.

  • Authentication.

  • Email delivery.

  • Other Platform infrastructure.

Third-party services may be subject to their own terms, privacy policies, security practices, and data-retention practices.

Cry-Fi does not control all third-party systems or practices and, subject to applicable law, is not responsible for failures or conduct outside its reasonable control.


23. Policy Integration

These Terms operate together with applicable Cry-Fi policies, including:

  • Privacy Policy.

  • Cookie Policy.

  • Refund & Cancellation Policy.

  • Booking Terms.

  • Community Guidelines.

  • Code of Conduct.

  • Registration Terms.

  • Listener Agreement.

  • Listener Vetting & Verification Policy.

  • Submission Terms.

  • Content Moderation Policy.

  • Safety & Reporting Policy.

  • Session Mode & Safety Policy.

  • Session Scope & Limitations Policy.

  • Security & Breach Response Policy.

  • Data Retention & Deletion Policy.

  • Intellectual Property & Copyright Policy.

  • Jurisdiction & Governing Law Policy.

  • Not-a-Therapy & No Medical Advice Disclaimer.

  • Accessibility Policy.

  • Age Restriction (18+) Policy.

  • Affiliate & Advertising Disclosure Policy.

Where a specific Cry-Fi policy addresses a particular subject in greater detail, that specific policy will govern that subject to the extent permitted by applicable law.

Where two provisions cannot reasonably be reconciled, these Terms generally govern the Platform-wide contractual relationship, subject to any more specific policy provision and any mandatory rights or obligations imposed by applicable law.


24. Changes to Terms

Cry-Fi may modify these Terms from time to time to reflect changes in:

  • The Platform.

  • Services.

  • Business operations.

  • Security requirements.

  • Legal or regulatory requirements.

  • Platform functionality.

Updated Terms become effective upon publication unless otherwise stated.

Where applicable law requires additional notice or consent for material changes, Cry-Fi will take the measures required by that law.


25. Governing Law & Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of India, subject to applicable mandatory legal protections.

Subject to applicable law, disputes arising from or relating to Cry-Fi shall be subject to the competent courts located in Bangalore, Karnataka, India.

This section operates together with the Jurisdiction & Governing Law Policy.

Nothing in this section is intended to prevent a user from exercising any mandatory legal right or remedy that cannot lawfully be excluded.


26. Voluntary Contributions & Support

Cry-Fi may provide users with an option to make voluntary contributions to support the development, maintenance, and improvement of the Platform.

Such contributions:

  • Are entirely optional.

  • Are not required to access or use Cry-Fi.

  • Are not payments for emotional support sessions.

  • Are not subscriptions or memberships.

  • Do not affect account status, visibility, access, booking eligibility, or user experience.

Unless otherwise required by applicable law or resulting from a duplicate or erroneous transaction, voluntary contributions are non-refundable.

Where applicable, contributions may be processed through third-party payment providers and may be subject to their processing terms.

By making a contribution, you acknowledge that it is made voluntarily to support Cry-Fi and is separate from payments for Listener services.
