These Terms & Conditions (“Terms”) govern your access to and use of Cry-Fi (“Cry-Fi”, “Platform”, “we”, “our”, or “us”), including all services, content, sessions, features, and communications provided through the platform.

By accessing, registering, or using Cry-Fi, you agree to be legally bound by these Terms and all associated policies. If you do not agree, you must immediately discontinue use.

1. Platform Nature

Cry-Fi is a technology-based marketplace platform that connects users with independent listeners for emotional support conversations.

Cry-Fi:

  • Does not provide therapy, counseling, psychiatry, or medical treatment

  • Does not employ listeners as employees

  • Does not supervise or control live sessions

  • Does not guarantee emotional outcomes or participant behavior

Listeners operate independently and remain solely responsible for their actions.

2. Eligibility

To use Cry-Fi:

  • You must be at least eighteen (18) years old

  • You must provide truthful and accurate information

  • You must have the legal capacity to enter into binding agreements

Cry-Fi reserves the right to verify eligibility and remove any violating accounts.

3. Services Offered

Cry-Fi may provide:

  • Online sessions

  • Offline sessions

  • One-on-one sessions

  • Group sessions

  • Messaging-based support

  • Other emotional support formats introduced by the platform

Service availability may change without notice.

4. User Responsibility & Assumption of Risk

All participation on Cry-Fi is voluntary.

Users and listeners agree that:

  • They engage at their own discretion

  • They are solely responsible for their personal decisions

  • They are responsible for evaluating trust and compatibility

  • Cry-Fi does not guarantee safety, reliability, or outcomes

Offline sessions carry increased risks and remain entirely the responsibility of the participants.

5. Strict Prohibition of Sexual Misconduct

Cry-Fi enforces a strict zero-tolerance policy for:

  • Sexual conversations

  • Sexual intent-based interactions

  • Sexual requests

  • Explicit content

  • Suggestive communication

  • Harassment

  • Sexual coercion

  • Sexual assault

  • Non-consensual conduct

This applies across:

  • Chats

  • Calls

  • Online sessions

  • Offline sessions

  • Group sessions

Any violation may result in immediate account suspension, permanent ban, and cooperation with legal authorities where required.

6. Fraud, Misrepresentation & Cheating

Users and listeners must not:

  • Misrepresent identity

  • Provide false information

  • Manipulate session outcomes

  • Create false claims for refunds

  • Submit fabricated evidence

  • Attempt payment fraud or chargebacks without valid basis

Cry-Fi reserves the right to investigate and act against fraudulent behavior.

7. Abuse & Session Termination

If any participant engages in:

  • Harassment

  • Threats

  • Abuse

  • Sexual misconduct

  • Manipulation

  • Illegal conduct

the other participant may terminate the session immediately.

Cry-Fi may require supporting evidence for disputes.

Refund decisions will follow the Refund & Cancellation Policy.

8. Force Majeure

Neither Cry-Fi nor its users or listeners shall be liable for any failure or delay in performing obligations under these Terms where such failure or delay results from events beyond the reasonable control of the affected party, including but not limited to:

  • Natural disasters
  • Floods, earthquakes, storms, or other severe weather events
  • Fire or explosions
  • War, terrorism, civil unrest, riots, or armed conflict
  • Government actions, regulations, or restrictions
  • Epidemics, pandemics, or public health emergencies
  • Internet outages or telecommunications failures
  • Power outages
  • Cyberattacks, distributed denial-of-service (DDoS) attacks, ransomware incidents, or other large-scale security events
  • Failures of third-party hosting providers, cloud infrastructure, payment processors, communication platforms, or other essential service providers or Any other event beyond the reasonable control of the affected party.

During such events, Cry-Fi may suspend, delay, modify, or limit certain services without incurring liability.

Cry-Fi will make reasonable efforts to restore normal operations as soon as reasonably practicable.

Nothing in this section limits any rights or obligations that cannot be excluded under applicable law.

9. Offline Sessions Disclaimer

Cry-Fi does not arrange, supervise, or control offline meetings.

Users acknowledge that:

  • Offline sessions are voluntarily initiated by participants

  • Cry-Fi does not guarantee physical safety

  • Cry-Fi is not liable for personal harm, assault, theft, or misconduct

Participants accept all associated risks.

Cry-Fi strongly recommends exercising caution in offline interactions.

10. Group Session Disclaimer

Group sessions involve shared participation.

Cry-Fi does not guarantee:

  • Confidentiality between participants

  • Behavior of other attendees

  • Privacy of shared discussions

Participants accept these risks voluntarily.

11. No Professional Services

Cry-Fi is not a substitute for:

  • Therapy

  • Psychiatry

  • Medical treatment

  • Legal advice

  • Clinical support

No information provided on Cry-Fi should be treated as professional advice.

12. Payments

Payments are processed through third-party payment providers.

Cry-Fi:

  • Does not store sensitive payment data

  • May retain platform commissions

  • May hold payouts during disputes or investigations

Users agree to all charges before booking.

13. Refunds & Disputes

Refunds are governed solely by the Refund & Cancellation Policy.

Cry-Fi retains full discretion over:

  • Refund approvals

  • Dispute outcomes

  • Evidence review

Refund abuse may result in account action.

14. Off-Platform Conduct

Cry-Fi discourages unauthorized movement of sessions or payments outside the platform.

Cry-Fi shall not be responsible for any disputes, losses, or incidents arising from off-platform interactions.

15. Emotional Dependency & Exploitation

Listeners must not intentionally create unhealthy emotional dependency for financial gain.

Users must exercise independent judgment.

Cry-Fi may investigate suspicious patterns and take corrective action.

16. Advertising, Affiliate Links & Shop

Cry-Fi may display:

  • Advertisements

  • Affiliate links

  • Sponsored content

  • Shop listings

Cry-Fi may earn revenue from these sources.

Cry-Fi does not guarantee or assume liability for third-party products or services.

17. Account Suspension & Termination

Cry-Fi reserves the right to:

  • Suspend accounts

  • Terminate accounts

  • Remove listings

  • Restrict access

at its sole discretion for policy violations, fraud, abuse, or safety concerns.

18. Intellectual Property

All Cry-Fi content, branding, software, and materials are protected intellectual property.

Unauthorized reproduction or use is prohibited.

19. Limitation of Liability

To the fullest extent permitted by law, Cry-Fi shall not be liable for:

  • Personal injury

  • Sexual assault

  • Harassment

  • Emotional harm

  • Financial losses

  • Fraud by users or listeners

  • Offline incidents

  • Group confidentiality breaches

  • Third-party service failures

Use of Cry-Fi is entirely at your own risk.

20. No Compensation for Damages

Except where expressly provided under the Refund Policy, Cry-Fi shall not provide compensation, damages, reimbursement, or settlement for:

  • Personal harm

  • Emotional distress

  • Offline incidents

  • Participant misconduct

  • Dissatisfaction with services

21. Indemnification

You agree to indemnify and hold Cry-Fi harmless from any claims, losses, liabilities, damages, and legal expenses arising from:

  • Your use of the platform

  • Your conduct

  • Your interactions with other participants

  • Your violation of these Terms

22. Third-Party Services

Cry-Fi may use third-party providers for:

  • Payments

  • Hosting

  • Analytics

  • Advertising

  • Security

Cry-Fi shall not be liable for third-party failures or breaches.

23. Policy Integration

These Terms incorporate all Cry-Fi policies, including:

  • Privacy Policy

  • Refund & Cancellation Policy

  • Code of Conduct

  • Session Mode & Safety Policy

  • Safety & Reporting Policy

  • Content Moderation Policy

  • Listener Agreement

  • Security Policies

All policies form part of these Terms.

24. Changes to Terms

Cry-Fi may modify these Terms at any time.

Continued use after changes constitutes acceptance.

25. Governing Law & Jurisdiction

These Terms shall be governed by the laws of India.

All disputes shall be subject to the exclusive jurisdiction of courts in India.
