Jurisdiction & Governing Law Policy

This Jurisdiction & Governing Law Policy (“Policy”) describes the governing legal framework applicable to the use of Cry-Fi (“Cry-Fi”, “Platform”, “we”, “our”, or “us”), including its services, bookings, sessions, policies, and Platform interactions.

This Policy should be read together with Cry-Fi’s Terms & Conditions and other applicable policies.


1. Governing Law

To the extent permitted by applicable law, the relationship between you and Cry-Fi, and any dispute arising from or relating to the Platform, shall be governed by and construed in accordance with the laws of India, without regard to conflict-of-law principles.

Nothing in this Policy is intended to exclude or restrict mandatory legal rights or protections that cannot lawfully be waived or excluded.


2. Jurisdiction

Subject to applicable law, disputes arising directly between you and Cry-Fi shall be subject to the jurisdiction of the competent courts located in:

Bangalore, Karnataka, India

This jurisdiction provision applies to the extent permitted by applicable law and does not prevent a user from exercising a mandatory right to bring a claim before another court, forum, authority, or tribunal where such right cannot legally be restricted.


3. International Users

Cry-Fi may be accessible to users and Listeners internationally.

Users accessing Cry-Fi from outside India acknowledge that:

  • Cry-Fi is operated from India.

  • The Platform’s contractual framework is primarily based on Indian law.

  • Their use of Cry-Fi may also be subject to mandatory laws applicable in their country or jurisdiction.

  • They are responsible for complying with laws applicable to their own conduct and location.

  • Certain Cry-Fi features or services may not be available in every jurisdiction.

Cry-Fi does not represent that every Platform feature, service, or policy complies with every law in every country.


4. Platform Nature

Cry-Fi operates as a technology marketplace connecting Support Seekers with independent Listeners.

Cry-Fi does not:

  • Act as a therapist

  • Act as a healthcare provider

  • Provide medical treatment

  • Employ Listeners solely by virtue of their participation on the Platform

  • Guarantee professional qualifications beyond any verification or vetting processes Cry-Fi actually performs

  • Supervise physical or offline meetings

  • Control participants’ conduct outside the Platform

The independent nature of Listeners and Cry-Fi’s role as a technology marketplace are relevant to the relationship between Cry-Fi, Support Seekers, and Listeners.


5. Online & Video Sessions

Cry-Fi may provide online and Video Session functionality through the Platform and integrated third-party technology.

Video Sessions may involve third-party technology providers and infrastructure.

Participants are responsible for complying with applicable laws relating to:

  • Privacy

  • Recording

  • Consent

  • Copyright

  • Communications

  • Personal information

  • Conduct during sessions

Cry-Fi does not guarantee that the laws of every jurisdiction permit every possible use of Video Session functionality.

Cry-Fi does not represent that live Video Sessions are automatically recorded or continuously monitored by Cry-Fi.


6. Dispute Resolution Preference

Before initiating formal legal proceedings against Cry-Fi, users and Listeners are encouraged to first attempt to resolve the matter through Cry-Fi’s internal grievance process.

Concerns may be submitted through the applicable Cry-Fi support or reporting channels.

Cry-Fi may review the matter under its Grievance Redressal Policy.

Internal review does not prevent a person from exercising rights or remedies that cannot legally be waived.

Cry-Fi does not guarantee that every dispute will be resolved through internal review.


7. Individual Claims

To the fullest extent permitted by applicable law, claims against Cry-Fi should be brought individually unless applicable law permits or requires otherwise.

Nothing in this section is intended to restrict any right or remedy that cannot legally be waived or restricted.


8. Cross-Border Legal Compliance

Cry-Fi may cooperate with:

  • Courts

  • Law-enforcement agencies

  • Regulatory authorities

  • Government authorities

  • Other legally authorized bodies

in India or other jurisdictions where Cry-Fi is legally required or permitted to do so.

Cry-Fi may preserve, disclose, or provide relevant information in accordance with applicable law and its Privacy Policy.


9. Severability

If any provision of this Policy is determined to be invalid, unlawful, or unenforceable, that provision shall be interpreted, modified, or limited to the extent necessary where legally permitted.

The remaining provisions shall continue to apply to the fullest extent permitted by law.


10. Policy Integration

This Policy forms part of Cry-Fi’s broader legal framework and should be read together with:

  • Terms & Conditions

  • Privacy Policy

  • Refund & Cancellation Policy

  • Booking Terms

  • Code of Conduct

  • Community Guidelines

  • Content Moderation Policy

  • Session Mode & Safety Policy

  • Safety & Reporting Policy

  • Listener Agreement

  • Not-a-Therapy & No Medical Advice Policy

  • Other applicable Cry-Fi policies

Where multiple policies address the same subject, they should be interpreted together to the extent reasonably possible.

If an inconsistency cannot reasonably be reconciled, the applicable provision of the Terms & Conditions will generally govern, subject always to mandatory applicable law.


11. No Waiver of Mandatory Rights

Nothing in this Policy is intended to:

  • Remove mandatory consumer rights

  • Exclude legally required protections

  • Prevent lawful regulatory complaints

  • Prevent lawful reporting to authorities

  • Restrict rights or remedies that cannot legally be waived

Where applicable law provides a user with rights or protections that conflict with this Policy, the mandatory legal requirements will apply.


12. Changes to This Policy

Cry-Fi may update this Policy from time to time.

The updated version will be published on the Platform with a revised “Last Updated” date.

Where required by applicable law, Cry-Fi may provide additional notice regarding material changes.
