Intellectual Property & Copyright Policy

This Intellectual Property & Copyright Policy (“Policy”) governs the ownership, use, protection, and reporting of intellectual property associated with Cry-Fi (“Cry-Fi”, “Platform”, “we”, “our”, or “us”).

This Policy applies to Platform content, user-generated content, copyright and trademark concerns, and intellectual property-related reports submitted through Cry-Fi.


1. Ownership of Platform Content

Unless otherwise stated, Cry-Fi-owned content and materials, including but not limited to:

  • Cry-Fi name and branding

  • Logos and trademarks

  • Website design

  • Text and written materials

  • Graphics

  • Platform structure

  • Software and code

  • Features and functionality

  • Blog content

  • Marketing materials

  • Original visual assets

  • Platform documentation

are owned by Cry-Fi or its licensors and may be protected by applicable intellectual property laws.

Unauthorized copying, reproduction, modification, distribution, public display, or commercial exploitation of Cry-Fi-owned materials is prohibited unless authorized by Cry-Fi or otherwise permitted by law.


2. Limited License to Use Cry-Fi

Cry-Fi grants users and Listeners a limited, non-exclusive, non-transferable, revocable license to access and use the Platform for its intended purposes and in accordance with Cry-Fi’s policies.

This license does not grant ownership of:

  • Cry-Fi intellectual property

  • Platform software

  • Branding

  • Website content

  • Proprietary features

  • Platform designs

  • Other Cry-Fi-owned materials

Any use outside the intended Platform purpose requires appropriate authorization or a separate legal basis.


3. User-Generated Content

Users and Listeners may submit or create content through Cry-Fi, including:

  • Profile information

  • Profile descriptions

  • Reviews

  • Messages

  • Uploaded materials

  • Session-related submissions

  • Reports

  • Feedback

  • Other user-generated content

Users generally retain ownership of original content they create, subject to applicable law and any rights belonging to third parties.

By submitting content to Cry-Fi, you grant Cry-Fi a non-exclusive, worldwide, royalty-free license, to the extent reasonably necessary to:

  • Store and host the content

  • Display the content where required to provide Platform functionality

  • Process the content

  • Moderate the content

  • Review reported content

  • Provide Platform services

  • Facilitate bookings and sessions

  • Investigate safety or policy violations

  • Prevent fraud and abuse

  • Resolve disputes

  • Maintain and improve Platform operations

  • Comply with legal obligations

Cry-Fi will not receive ownership of your original content merely because you submit it.

This license does not permit Cry-Fi to sell your original user-generated content as an independent product or otherwise exploit it beyond legitimate Platform, safety, operational, legal, or related business purposes, unless you separately authorize such use or applicable law permits it.


4. Video Session Content

Cry-Fi may provide live Video Sessions between authorized participants.

Participants remain responsible for intellectual property displayed, communicated, uploaded, shared, or otherwise used during a Video Session.

Participants must not use a Video Session to:

  • Display copyrighted material without appropriate authorization

  • Broadcast unauthorized movies, television programs, music, or other protected works

  • Share pirated material

  • Infringe another person’s copyright

  • Impersonate brands or creators

  • Distribute unauthorized copies of protected content

Where screen-sharing or similar functionality is available, the participant using that functionality remains responsible for ensuring that the material being displayed may legally be shared.


5. Recording, Screenshots & Session Materials

Participants should respect intellectual property, privacy, and other rights when recording, capturing, reproducing, or sharing session content.

Without appropriate authorization or legal basis, users must not:

  • Record sessions for unauthorized commercial use

  • Reproduce another participant’s original content

  • Publish session content

  • Distribute screenshots or recordings

  • Sell or commercially exploit another participant’s content

  • Re-upload session materials to other platforms

Any recording or capture must comply with applicable copyright, privacy, consent, and other laws.

Cry-Fi does not represent that Video Sessions are automatically recorded or stored by Cry-Fi.

Where a third-party video service is used, its own processing, storage, and retention practices may also apply.


6. Responsibility for Submitted Content

Users and Listeners are responsible for ensuring that content they submit or use through Cry-Fi:

  • Belongs to them; or

  • Is appropriately licensed to them; or

  • Is otherwise legally permitted to be used.

Users must not knowingly submit, display, distribute, or use content that infringes another person’s intellectual property rights.

Where content incorporates third-party materials, the user is responsible for obtaining any permissions, licenses, consents, or other rights required for the intended use.


7. Prohibited Intellectual Property Violations

The following activities are prohibited:

  • Copyright infringement

  • Trademark infringement

  • Unauthorized copying

  • Unauthorized reposting

  • Unauthorized distribution

  • Pirated content

  • Brand impersonation

  • Unauthorized commercial use

  • Use of stolen content

  • Misleading ownership claims

  • Circumvention of intellectual-property protections

Violations may result in content removal, restriction of access, session termination, account restrictions, suspension, or permanent removal, subject to applicable law and Cry-Fi’s other policies.


8. Copyright Complaints

If you believe copyrighted material has been used on Cry-Fi without authorization, you may submit a copyright complaint.

Cry-Fi may process copyright notices in accordance with applicable law. Where U.S. copyright law applies, this may include a DMCA-style notice and associated procedures.

A copyright notice should generally include:

  • Your full name

  • Contact information

  • Identification of the copyrighted work

  • Description of the allegedly infringing material

  • Location or URL of the material on Cry-Fi

  • Explanation of why the use is unauthorized

  • Statement of good-faith belief

  • Confirmation that the information provided is accurate

  • Any legally required declaration or signature

Copyright notices may be submitted to:

Cry-Fi may remove, restrict, or disable access to allegedly infringing material where appropriate.

Submitting a complaint does not guarantee removal or any particular outcome.


9. Counter-Notice

Where applicable, a user whose content has been removed or restricted following a copyright complaint may submit a counter-notice containing the information required by applicable law.

A counter-notice may include:

  • Identification of the removed or restricted material

  • Explanation of why the removal or restriction is disputed

  • Contact information

  • Required legal statements

  • Any legally required consent to jurisdiction

  • Signature where required

Cry-Fi may review the counter-notice and take action consistent with applicable law.

Cry-Fi does not guarantee that removed or restricted content will be restored.


10. Repeat Infringers

Cry-Fi may restrict, suspend, or terminate accounts associated with repeated or serious intellectual property violations.

Cry-Fi may consider relevant reports, confirmed violations, account history, and other available information when determining appropriate enforcement.

Enforcement decisions may depend on the nature, seriousness, frequency, evidence, and applicable legal requirements relating to the alleged violations.


11. Trademark Protection

“Cry-Fi”, its logos, branding, names, designs, and associated marks may not be used without appropriate authorization.

Unauthorized use that:

  • Suggests affiliation with Cry-Fi

  • Creates confusion

  • Impersonates Cry-Fi

  • Misrepresents sponsorship

  • Uses Cry-Fi branding commercially without permission

may result in appropriate enforcement action.

Nothing in this section prevents lawful descriptive, nominative, or otherwise legally permitted use.


12. Third-Party Content

Cry-Fi may provide access to or display third-party materials, including:

  • Advertisements

  • Affiliate materials

  • Sponsored content

  • Embedded media

  • Third-party integrations

  • External links

  • User-submitted materials

Ownership of third-party content remains with the applicable rights holder.

Cry-Fi does not claim ownership of third-party intellectual property merely because it appears on or is accessible through the Platform.

Third-party services and content may be subject to separate terms, licenses, privacy policies, or other conditions imposed by their respective providers or rights holders.


13. No General Monitoring Obligation

Cry-Fi does not guarantee proactive monitoring of all Platform content for intellectual property violations.

Cry-Fi may investigate:

  • Reported violations

  • Content identified through Platform processes

  • Content associated with safety or policy investigations

  • Content where legal compliance requires action

  • Other matters that reasonably require review

The absence of immediate action does not constitute authorization of infringing activity.

Nothing in this section limits any obligation that may apply to Cry-Fi under applicable law.


14. False Intellectual Property Claims

Users must not knowingly submit fraudulent, abusive, or materially misleading copyright or intellectual property complaints.

Abusive reporting may result in:

  • Warning

  • Account restriction

  • Suspension

  • Permanent account removal

  • Other appropriate action

Nothing in this section prevents legitimate good-faith intellectual property complaints or disputes.


15. Limitation of Responsibility

Users and Listeners remain responsible for intellectual property violations arising from content they create, upload, display, distribute, or use.

Cry-Fi does not assume responsibility for unauthorized content submitted or used by users beyond its applicable legal obligations and matters reasonably within Cry-Fi’s control.

Cry-Fi may take appropriate action when it receives a valid complaint or otherwise becomes aware of an apparent violation.

Nothing in this Policy excludes or limits liability that cannot lawfully be excluded or limited under applicable law.


16. Policy Changes

Cry-Fi may update this Policy from time to time.

The updated version will be published on the Platform with a revised “Last Updated” date.

Where required by applicable law, Cry-Fi may provide additional notice regarding material changes.
